Seeds and Plant Material Act 2005 into force

Board for Plant Varieties

The ‘Seeds and Pant Material Act 2005’ has entered into force on 1st of February 2006. From that date on the Board for Plant Varieties starts to operate. The Board for Plant Varieties is responsible for

·         the grant of national plant breeders’ rights

·         the listing of agricultural varieties

·         the listing of vegetable varieties

·         the listing of forestry varieties and stands

Thus the Board for Plant Varieties replaces:

·         the Board for Plant Breeders’ Rights

·         the Committee for the Variety List (Agricultural species)

·         the Committee for the listing of Vegetable varieties

·         the committee for the listing of Forestry crops

Applications for

·         national plant breeders’ rights

·         listing of agricultural varieties (DUS + VCU)

·         listing of vegetable varieties (either with or without breeders’ trials)

should be filed at the Board for Plant Varieties

Office for Plant Varieties and Naktuinbouw

Since January 1st, 2008 the Board for Plant Varieties is supported by the Office for Administration and Documentation, which is part of Naktuinbouw, department Varieties & Trials. Variety testing

·         DUS testing is performed by Naktuinbouw and designated foreign stations.
If so requested breeders’ trials may be included for vegetables.

·         VCU testing is organised by the breeders and performed by several stations in NL.

Application procedure

Applications for plant breeders’ rights and/or listing should be filed at the Board for Plant Varieties. The applicant should indicate the goal of his application. An application for listing of a variety of an agricultural species, for which VCU is obligatory, implies that DUS and VCU testing must be performed.

The applicant may indicate that he himself will contract the Naktuinbouw to perform the DUS testing. This option (not applicable to species, for which the DUS testing is performed by designated foreign stations) may bear certain tax advantages and is subject to the following conditions:

  1. The application concerns a species, for which the DUS testing will not be performed by a foreign testing station on the basis of a bilateral cooperation agreement.
  2. The applicant agrees to the transfer of the test results to the Board for Plant Varieties
  3. The application has been accepted.

With regard to vegetables the applicant may indicate that breeders’ trials should be taken into account.

An application, consisting of fully filled in and signed forms and TQ, will be accepted after payment of

 

Examination procedure

After the applicant has been informed about the acceptance of his application the examination procedure starts, unless the test report will be taken over (see under ‘Taking over of reports’). The Board for Plant Varieties will inform the applicant about the sample (quantity and quality), the period in which and the location where the sample should be furnished. Naktuinbouw will give further instructions concerning the breeders’ trials.

Taking over of reports

When an earlier application for the variety concerned has been filed in a UPOV state, the Board for Plant Varieties may ground its decision on the test results following that earlier application.

Value for Cultivation and Use (VCU)

For most agricultural species VCU is obligatory. The Board for Plant Varieties will use the results of VCU tests organized by the breeders in conformity with conditions set by that Board. Only test results of varieties which have been filed before the ultimate application date will be taken into account.

Fees as from 1st of January 2008

Application fee

For each application for PBR, for listing or for PBR and listing (provided that they are filed simultaneously) an application fee is due, see www.naktuinbouw.nl. When the applications for PBR and listing of one variety are filed separately, there is an extra charge. Payments should be made to the bank account of Naktuinbouw.

Fees for DUS testing in the Netherlands

The examination fees (to be charged by the Board for Plant Varieties) are not applicable when the applicant himself has contracted the Naktuinbouw to perform the tests. In those cases the Naktuinbouw will charge its remuneration to the applicant directly. See amounts on www.naktuinbouw.nl + 19%.

Fees for DUS testing by foreign testing stations

The testing fee equals the remuneration of the foreign testing station.

Taking over fee

This fee has to be paid at the time of application. See www.naktuinbouw.nl.

Annual fee

Since January 1st 2007 there is no annual fee anymore for registered varieties.
